Exemption criteria
Broadly speaking, a broadcaster is exempt if:
- it employs no more than 20 people and/or
- its licence is for 31 or fewer days' broadcasting in a year.
The exemption criteria are given in Communications Act 2003, Section 337.
Broadcasters are responsible for:
- obtaining any professional advice they might need in order to decide whether they are eligible for exemption
- retaining the evidence necessary to support an exemption claim.
